Article 3. Intellectual property
GEMSTER and/or its partners exclusively hold all intellectual property rights relating to the structure and content of the Gemster application worldwide. This includes the proprietary recommendation algorithm, visual identity, logo, mascot, databases, text and visuals. This does not extend to the records, visuals and metadata relating to cultural works (covers, posters, summaries), which come from third-party partner databases and remain the property of their respective rights holders (see Article 7).
Any reproduction, representation, modification, distribution or exploitation, in whole or in part, of the application content without GEMSTER's prior express authorization is strictly prohibited and may lead to legal proceedings.
Article 4. Data protection
Gemster collects and processes users' personal data to provide its cultural recommendation, work tracking and account management services.
In accordance with French law no. 78-17 of January 6, 1978 on data processing, files and freedoms, and the General Data Protection Regulation (GDPR), users have rights of access, rectification, portability and objection regarding their personal data. These rights can be exercised from account settings or by contacting: hello@gemster.io. Details of the purposes, legal bases, recipients and retention periods are set out in our Privacy Policy.
Article 5. Cookies
The Gemster application only uses trackers that are strictly necessary for the service to function (browser local storage used to maintain your session and preferences). These trackers are exempt from consent under applicable regulations.
Audience measurement is performed without cookies, using the Umami tool hosted in the European Union: it neither stores nor reads any information on your device and collects no data that can identify you. This processing, based on our legitimate interest, is not subject to prior consent, so no consent banner is required. No advertising or third-party tracking cookies are used. For more details, see Article 7 of our Privacy Policy.
Article 6. Reporting illegal content
In accordance with applicable law, any user may report manifestly illegal content by contacting Gemster at: hello@gemster.io, or by registered mail to the registered office mentioned in Article 1.
Article 7. Limitation of liability
Gemster strives to keep its content current and accurate. However, GEMSTER may not be held liable for errors or omissions in information available in the application, or for service interruptions caused by external events such as maintenance, force majeure or network failures.
Information about cultural works (records, release dates, summaries) comes from third-party partner databases. GEMSTER does not guarantee its completeness or accuracy.
